Behar and Caplan: Yes, Well obviously you can’t say what the Supreme Court is going to do, but I think there is something wrong if you are part of a racial caste system. The only way to break it down is you make it right, you let people choose how they are going to send their children to school, whatever that school is. It’s your child, your taxpayer’s money, they are not getting a better education for their children because of who they are. It’s not right and we are not doing what we should be doing as a society. So I think that is very important. Obviously there is no way the Supreme Court is going to make it totally right. But if the Supreme Court does not make it bad, then I think there are enough people in certain states that would still like to take the education of our children into their own hands and separate them.

Bharara on, Well the Supreme Court has never been a judge. They have never seen or heard the legislative product or so the five judges up there are going to let the fact that they are part of a minority party dictate the way this case has to be run. I would love to have more Republican judges on the Supreme Court but that’s not going to happen. But the trial judges in the cases have voted and the Supreme Court just has to listen to those opinions, those jurisprudence opinions and assess the burden of proof and the judge has to make the right call at the end. I think maybe there is a way to satisfy the Supreme Court. Here’s the problem. The votes in the Senate are not going to change. We’re not going to change the composition of the Supreme Court. We’re going to change the composition of the senate and we are going to convince a certain constituency to either change their vote or to be with us.
